Passive skills ignoring required tech?

Noticed while testing an event in my map that some of the creeps that I had given a passive skill to were gaining the effects of it when they would only be given it if the players were playing on a higher difficulty (ex. Zombies having a reincarnation ability) is this a known issue or just some weird random bug.
