Making Custom MPQs

I'm currently working on a vast single player RPG for wc3 and I'm thinking about making a custom MPQ for it. I have a few questions regarding the issue:

1. Is it legal to edit MPQs and make them available for download?

If it is legal:
2. Is it possible to make an entirely new MPQ which won't affect the game MPQs but maps will still be able to read from it?
3. In case, making a new MPQ is not possible, which one will be best to edit: war3patch or war3xlocal.
