Dear Hive,

I thought about modifying an custom model by customizing its texture (for my own project not for realease on hive). The original author of this model wrote in the description, that it should not be modified without his permisson. The problem now is that he was not online for about 3 years. What do you think: can I just modify the texture or should I avoid it?

I think it is fine as long as you make the texture (custom skin) entirely from scratch so it is not a modification of their work. Of course you still need to credit them for the model itself.

If the map or model/skin is never publicly released you can do whatever you want to it as there are no witnesses that the action ever occurred.
