Unfortunately, software pirates have spoiled this situation for hobbyists. We are constantly working to improve Battle.net, and we sincerely hope that one day, no one will see any reason to seek alternatives to Battle.net for playing Blizzard games.

Your games sell millions of copies. Why do you care if a few people pirate your software?
The sales success of a product should not exclude it from laws intended to protect intellectual property. Software piracy needs to be combated at all levels, and at Blizzard we intend to do our part to fight illegal distribution of copyrighted media.

That is a lie. It's a generalization and can't stand anywhere, let alone in a courtroom.

The problem with fine print:
"Blizzard products are intellectual property, and we are well within our legal rights to protect our products from software piracy."
Sentences like that one.

Actually, people like Jacek and Blizzard ruin it for hobbyists.

Has NOTHING to do with the issue. But it does look nice on Blizzard's part to have that right after their spiel to be defensive.

You remember that problematic "fine-print" sentence i pointed out? The problem lies within it's liability. Is an owner of a server liable for the pirating of non-affiliated individuals? No. Does an owner of a server have the right to host, let me rephrase, ALLOW non-affiliates to connect online via their server? Yes. You see, the server simply allows people to connect to one another. All data and programming is done in the game itself. The server simply hosts a connection.

Jacek, it's called a "scare-tactic". In such a case as this, it is NOT enforceable. Now, had the owner installed any file (like how PHP opperates) which Blizzard created to ALLOW online connectivity through servers, then there is a legitamate issue. However, no legal action can be taken.
And if you want to get technical, just think of all the wires running through the ground, through public and private property.

The issue which that quote deals with is piracy. That is Blizzard Vs. Joe Blow - internet junkie/pirateer, NOT Blizzard Vs. Joe Blow - owner of server.

They turned a verbal attack (scare-tactic) in only one sentence about server-hosting to all about piracy of software the rest.

Jacek, i read this kind of crap.. I mean, i really read it. If you can't think like a lawyer, you're one to be posting such nonsense. Do you know what wins in court? Semantics. Why? Because all laws are designed to be ambiguous. You'll never find a law that is unequivocal in manner, meaning you won't ever find a law, in whole, where you don't say to yourself, "HUH?!".. That is, of course, unless you aren't paying much attention and even more, not thinking.
