Depends on how old it is. Eventually the makers may abandon it but for some reason I doubt that as many people are probably still using it.

There are many website available from where you can get 3ds max 4. usa.autodesk.com is best place to buy. There are free trial is also available.

if you dont want to buy it use gmax instead it does not have as many features as 3ds but its FREE
