Orb of Corruption Ability Ignoring Techtree

So I want a unit to gain an ability based on Orb of Corruption (increases damage, enables your anti-air attack, and causes your attacks to decrease enemy armor) when upgraded.

The trouble is that the unit always has that ability even when it is un-upgraded. Techtree- Check Dependencies is of course set to true and the requirements are definitely correct. Nonetheless, the unit always has Orb of Corruption.

Any idea what causes this?
 
Several other item abilities are working just fine with tech requirements as far as I can tell, so there must be some specific sub-category of item abilities it doesn't work with. I did think about the dummy upgrade option, but at the moment I'm mostly just curious about what causes this particular item ability to ignore tech-tree requirements.
