It is a good base, but the background makes the banner look fading.
You could try to make the phoenix more ... birdish as he rather looks like a red water elemental at the moment.
Additionally, I would recommend you to outline the borders of the banner to make it more independent from the background.

The phoenix looks not like a bird. Yeah I agree in what Ardenian said. You could also make the banner bigger to fit a better phoenix pose.

I don't really agree with this color background at all. Maybe a glow behind the banner itself instead of the whole background filled.

On a second look, I agree ^^
To be honest, I could do it way better, but I was in a rush and had this strong urge to upload it even if it wasn't anywhere near good enough >_>
I'll look into redrawing this in a few weeks when I'm done with my exams

We don't have many banner icons here, so it's a good idea.
U could zoom it in a bit.
The bg doesn't really fit.
U could change it, darken it or add some strong shading around the flag, to make it stand out better.
I never recommend black outlines.
Try to use darker tones of the colors that you've chosen.
The details on the flag need work.
The Phoenix can be represented in various ways, from the simplest, stylized, to the most complicated and realistic.
I see that u tried to draw a stylized Phoenix, but it doesn't look quite like a Phoenix, u need to work more on this.
Also, the whole banner needs some shading.
I would be happy to see an update of this flag.
